QR CODE COMPETITION OFFICIAL RULES
To be eligible, you must be a resident of the Cariboo Chilcotin who is the age of majority in your province of residence at the time of the end of the contest. Minors under the age of majority will be permitted to enter the Contest and be eligible to win the prize. In no case, however will a minor be declared a winner without the prior written consent and release of liability of the minor’s parent or legal guardian. You are not eligible if you are: a) a resident of any other province; or a resident living outside the Cariboo Chilcotin; b) a member of the Baker Creek Enhancement Society team (the “Sponsor”) or one of its development, advertising or promotional agencies or the prize suppliers or of any of their affiliates; or c) a member of the immediate family (defined as parent, sibling, child or spouse, regardless of where they reside) or household of any of the above persons.
2. HOW TO ENTER:
NO PURCHASE NECESSARY. Contest opens on or around 12:00:01 am (PST) on April 15th, 2016 and ends at 11:59:59 pm (PST) on July 18th, 2016 (PST). To enter; scan the QR Code on the contest poster, answer the questions and fill in the entry form. All fields on the entry form must be valid and completed unless they are indicated as optional.
3. THE PRIZE:
A belly boat with an approximate value of $400 Canadian.
The prize is not transferable and must be accepted as awarded with no substitutions of any kind. The prize will only be awarded to the verified winner. Prior to receiving the Prize, the Prize winner shall sign a standard release and liability waiver absolving the Sponsor of all its obligations under the Contest and accepting the Prize as awarded as full and final satisfaction of all items owed to him by the Sponsor. In the event it is impossible, difficult and/or costlier for the Sponsor to award a prize (or part of a prize) as described in these contest rules, the Sponsor reserves the right to award a prize of similar nature and equivalent value.
The contest administrator will attempt to contact the selected entrant at the email address or telephone number provided at the time of entry. The chances of winning depend upon the total number of entries received.
5. HOW TO WIN:
To be declared a winner, a selected entrant must (a) correctly answer a skill-testing question to be answered at a convenient time; (b) sign a declaration of compliance with the Contest Rules and a release of the Sponsor, its advertising and promotional agencies, Facebook.com, the affiliates of the foregoing and all of their respective directors, officers, owners, partners, employees, agents, representatives, successors and assigns (the “Releases’”) of any and all liability in connection with the Contest and the Prize; and (c) consent to the announcement of the winner’s name and its use by the Sponsor of the winner’s name, address, photograph likeness, voice or statements for advertising, information or promotional purposes without further compensation or notice to the winner. If a selected entrant cannot be contacted at the email address or telephone number provided by the selected entrant upon entry within 1 week, the Prize may be forfeited and awarded to an alternate entrant.
6. LIMITATIONS OF LIABILITY:
Without limiting any of the foregoing, Releases’ will not be liable for: a) any incomplete or inaccurate information, whether caused by use of the Sponsor’s website or by any equipment or programming associated with or utilized in the Contest, or by any technical or human error which may occur in the processing of entries; b) the theft, destruction or unauthorized access to, or alteration of, entries; c) any problems with, or technical malfunctions of, telephone networks or lines, computer online systems, servers or providers, computer equipment, software, viruses or bugs; d) damage to a participant’s or other person’s system occasioned by participation or downloading of materials in this Contest; or (e) erroneous, damaged, destroyed, late, incomplete, illegible, incorrectly addressed or misdirected entries, regardless of the cause; (f) failure for any reason whatsoever of selected entrants to receive Prize notification emails or telephone calls; or (g) change’s in entrant’s email address or telephone numbers after entries are submitted. Each entrant and any potential or declared winner releases the Sponsor, their subsidiaries, respective divisions, their advertising and promotional agencies, their shareholders, officers, directors, employees, agents and representatives (hereinafter the “Beneficiaries”) from any and all liability for any and all damage, loss or liability suffered as a result of or arising from the entrant’s participation in the contest or the acceptance or use of his/her prize. In order to be declared a winner and prior to obtaining his/her prize, any potential or declared winner agrees to sign a declaration to such effect in the release form. The guest of a winner (or a parent or legal guardian in the case of a minor) will also have to sign such a declaration to that effect in the release form, failing which they will not be able to take part in the prize.
8. RIGHT TO TERMINATE OR SUSPEND:
Sponsor shall not be liable on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof including any injury or damage to an entrant’s or any other person’s computer related to or resulting from the www.bakercreek.org website or the Contest. Sponsor reserves the right, at its sole discretion, to cancel or suspend this Contest should a virus, bug or other cause beyond the reasonable control of Sponsor and its directors, officers, representatives, advertising and promotional agencies, divisions and subsidiaries, corrupt the security or proper administration of the Contest. Entrants agree to abide by the contest rules. Sponsor reserves the right at its sole discretion to disqualify, from this Contest and any future contest or other promotion conducted by Sponsor, any individual that it finds or believes to be tampering with the entry process or the operation of the Contest or www.bakercreek.org website; to be acting in violation of the Contest Rules or to be acting in a disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any attempt by an entrant or any other person to deliberately damage any website or undermine the legitimate operation of the contest is a violation of criminal and civil laws and should such an attempt be made; Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.
Participation in the Contest constitutes acceptance and agreement to these Contest Rules. Entrants who have not complied with these Contest Rules are subject to disqualification from this Contest and any future contest or other promotion conducted by Sponsor. All decisions of Sponsor are final and binding in all matters relating to this Contest. Contest is subject to all applicable federal, provincial and municipal laws, and is void where prohibited by law. If any provision of these Contest Rules is found by any court of competent jurisdiction to be unenforceable, all other provisions will remain in full force and effect. In the event of a dispute regarding who submitted an online entry, the entry will be deemed submitted by the authorized account holder of the e-mail address submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization that is responsible for assigning email addresses for the domain associated with the submitted e-mail address. A selected entrant may be required to provide the Sponsor with proof that he/she is the authorized account holder of the email address associated with the selected entry.
